Governed by the laws of the State of Minnesota, USA. Privacy practices are designed to comply with the California Consumer Privacy Act (CCPA/CPRA) and we extend these rights to all users.

This Privacy Policy describes how Roadscue, Inc. ("Roadscue," "we," "us") collects, uses, shares, and protects personal information when you use the Roadscue customer app, the Roadscuer provider app, our websites, and related services (collectively, the "Services"). Roadscue is organized under the laws of the State of Minnesota. While Minnesota law governs our relationship with you, we have designed this Policy to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act ("CCPA/CPRA"), and we voluntarily extend the privacy rights described below to all of our users, regardless of the state in which they reside.

1. Information We Collect

a. Information You Provide

  • Account information: name, email, phone number, password, profile photo.
  • Vehicle information: make, model, year, color, license plate (when provided).
  • Service request information: location, situation description, photos you upload, notes.
  • Payment information: processed and stored by our payment processor (Stripe). We receive limited tokenized data such as card brand, last four digits, and authorization status.
  • Provider information (RAPs/MATs/SATs): business details, driver's license, insurance, vehicle documents, banking details for payouts (held by Stripe Connect), background-check data.
  • Communications: messages you send through in-app chat, support emails, and call recordings where required by law and disclosed.

b. Information Collected Automatically

  • Location data: precise geolocation when you request service, when a Provider is en route, and (for Providers) while you are on-duty. You can disable location at the OS level, but core features will not work without it.
  • Device & usage data: device type, OS, app version, IP address, language, time zone, crash logs, performance metrics, and interactions with the Services.
  • Cookies and similar tech: on the web, we use cookies and local storage for authentication, preferences, and analytics.
  • Push notification tokens for sending dispatch and account alerts.

c. Information from Third Parties

  • Identity, background-check, and insurance verification providers (Providers only).
  • Payment processor and fraud-prevention partners.
  • Mapping and geocoding providers (e.g., Google).
  • Authentication partners (e.g., Google Sign-In) when you choose to sign in with them.

2. How We Use Personal Information

  • Provide, operate, and improve the Services, including dispatching Providers and computing ETAs and pricing.
  • Process payments, payouts, refunds, tips, and platform fees.
  • Communicate service updates, verification codes, receipts, and support responses.
  • Verify identity, eligibility, insurance, and credentials of Providers.
  • Detect, investigate, and prevent fraud, abuse, and safety incidents.
  • Comply with legal obligations, including tax, accounting, and law-enforcement requests.
  • Send marketing or referral promotions where permitted (you may opt out).
  • Develop and improve features, train internal models, and conduct analytics.

3. How We Share Personal Information

  • With Providers and customers: we share the information needed to deliver and complete a service (e.g., the customer's first name, vehicle, location, and situation are shared with the assigned Provider; the Provider's first name, photo, vehicle, and live location are shared with the customer).
  • Service vendors: hosting and database (Supabase), payments (Stripe), messaging (Twilio, email providers), maps (Google Maps), analytics, customer-support tools, and similar processors who handle data on our behalf under contract.
  • Legal and safety: to comply with law, respond to lawful requests, enforce our Terms, and protect the rights, property, or safety of Roadscue, our users, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets.
  • With your consent for any other disclosure.

We do not sell your personal information for money. We do not knowingly engage in cross-context behavioral advertising of personal information of California residents. If that ever changes, we will provide a "Do Not Sell or Share My Personal Information" link and honor Global Privacy Control (GPC) signals.

4. CCPA/CPRA: Categories of Personal Information Collected (Last 12 Months)

  • Identifiers (name, email, phone, IP, device IDs).
  • Customer records (vehicle, payment data – tokenized).
  • Commercial information (services requested, transactions).
  • Internet/network activity (app usage, logs).
  • Geolocation data (precise, while using the Services).
  • Audio/visual (photos, in-app chat content, optional call recordings).
  • Professional/employment information (Providers only).
  • Inferences (service preferences, risk signals).
  • Sensitive personal information: precise geolocation and government ID for Providers — used only as needed to provide the Services and verify eligibility, and not for inferring characteristics.

5. Your Privacy Rights (CCPA/CPRA — Extended to All Users)

Although Roadscue is based in Minnesota, we extend the following CCPA/CPRA rights to all of our users. If you are a California resident, these rights are guaranteed to you by law. You have the right to:

  • Know what personal information we collect, use, disclose, and share.
  • Access a copy of your personal information.
  • Delete personal information, subject to legal exceptions.
  • Correct inaccurate personal information.
  • Limit use and disclosure of sensitive personal information to what is necessary to perform the Services.
  • Opt out of any future "sale" or "sharing" of personal information (we currently do not engage in either).
  • Non-discrimination for exercising these rights.

To exercise these rights, email privacy@roadscue.com from the email associated with your account, or call (866) 824-7172. We will verify your identity before responding. You may use an authorized agent; written authorization is required.

6. Data Retention

We retain personal information only as long as needed for the purposes described above, including to comply with tax, accounting, dispute-resolution, and other legal obligations. Trip and transaction records are typically retained for at least 4 years to meet applicable state and federal record-keeping requirements. Background-check and document data for Providers are retained for the duration of the Provider relationship plus the period required by law.

7. Security

We implement administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, role-based access, and Row-Level-Security database policies. No system is perfectly secure; please notify us immediately at security@roadscue.com if you believe your account has been compromised.

8. Children's Privacy

The Services are not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact privacy@roadscue.com and we will delete it.

9. Jurisdiction and U.S.-Based Processing

The Services are operated from the United States. Roadscue is organized under the laws of the State of Minnesota, and this Policy and any disputes arising under it are governed by Minnesota law, except where the CCPA/CPRA or other applicable state privacy law provides you with greater rights. If you access the Services from outside the U.S., you consent to the transfer and processing of your information in the United States.

10. SMS / Text Messaging Program (10DLC)

Roadscue operates an SMS messaging program for service updates, appointment alerts, dispatch notifications, ETA updates, payment links, verification codes, and account-related messages. By providing your mobile number through our website, mobile app, service-request flow, or verbally to Roadscue support/dispatch, and affirmatively agreeing to receive SMS (via checkbox, in-app consent screen, or recorded verbal consent), you consent to receive recurring automated text messages from Roadscue at the number provided. Consent is not a condition of purchase.

Message frequency varies based on your service activity. Message and data rates may apply. Reply HELP for help or STOP to cancel at any time. After replying STOP you will receive one final confirmation message and no further SMS from the program until you opt in again.

No mobile information, phone numbers, or SMS opt-in data will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors who directly support Roadscue's SMS messaging program (such as our messaging platform provider Telnyx) is permitted solely to deliver the messages you have consented to receive. All other categories of sharing exclude mobile opt-in information.

Carriers (including but not limited to AT&T, T-Mobile, Verizon, and their affiliates) are not liable for delayed or undelivered messages. For SMS-related questions, contact support@roadscue.com or call (866) 824-7172.

10b. Push Notifications and Calls

We also send push notifications and (where applicable) phone calls to keep you informed about your service requests and account. You may turn off push notifications in your device settings. Some service messages are necessary to provide the Services and cannot be turned off without closing your account.

11. Cookies

Our website uses essential cookies for authentication and preferences, and limited analytics cookies. You can control cookies through your browser settings. Disabling essential cookies will impair the Services.

12. Changes to this Policy

We may update this Policy from time to time. The "Effective date" above shows the latest revision. Material changes will be communicated through the app or by email.

13. California "Shine the Light"

California Civil Code §1798.83 permits California residents to request information about disclosures of personal information to third parties for direct marketing. We do not currently share personal information with third parties for their direct marketing.
